MTTuned.com Terms and Conditions / Waiver / Vehicle Compliance Affidavit

Compliance and Legal Notice:

US MARKET CUSTOMERS: Pursuant to the Clean Air Act 1970 - In the US Market, deleting emissions control devices is ILLEGAL. Our services do NOT require or endorse the use of aftermarket downpipes/catalytic converter deletes. MTTuned.com will not offer services to anyone we know has removed emissions control devices, such as catalytic converters. If such activity is discovered post-purchase, we will terminate all support immediately, and there will be NO REFUNDS. We require TOTAL LEGAL COMPLIANCE from all customers.

FOR COMPETITION USE ONLY: This is a race-only product designed and sold for vehicles intended solely for competition purposes. Vehicles modified with this product must not be used or registered for use on public roads or highways. Use of this product on a vehicle with emissions devices removed violates the Clean Air Act and may result in civil or criminal penalties, including fines of up to $4,819 per day.

The responsibility to comply with Federal, State, or Local laws and regulations lies solely with the Customer and/or installer.

Customer Waiver:

By requesting a custom tune from MTTuned.com, you, the Customer, acknowledge and accept the following:

Legal Compliance: You take full responsibility to ensure that your vehicle modifications conform to all applicable emissions and road safety laws.
Race-Only Product: You affirm that the vehicle is used exclusively for off-road/competition purposes and will not be driven on public roads.
Emissions Devices: MTTuned.com does not alter or disable emissions-related settings, suppress Check Engine Lights, or force system readiness for vehicles with missing emissions devices. All emissions-related settings remain OEM-compliant.
Dynamometer and Track Risks: You accept the inherent risks involved with testing and tuning, including potential damage to the engine, powertrain, or other components during dynamometer and track testing.

Refund Policy:

NO REFUNDS will be issued for delays, length of the tuning process, or dissatisfaction with results. The custom tuning process involves revisions and adjustments based on individual setups, and the timeline can vary significantly depending on engine and fuel quality.
Refunds will not be issued for unrealistic expectations or failure to adhere to these terms.

Dyno Tuning:

All dyno-tuning must be scheduled and confirmed with MTTuned.com in advance. Unauthorized scheduling will result in NO SUPPORT from our team. Rescheduling or cancellations will incur a $300 fee.

File Ownership and Communication:

Custom tunes are non-transferable and specific to the vehicle and owner.
Communication for support must be conducted through official channels (e.g., email or tuning platform comment sections). Social media platforms like Instagram or Facebook are not support channels.
Lost or deleted calibration files will require repurchase unless the customer has purchased our Off-site Data Backup Service.

Liability:

MTTuned.com is not responsible for:

Vehicle damage or failures during or after tuning.
Improper use of tuning files or components on public roads.
Lost time or additional costs associated with unforeseen issues during tuning.

Customer Behavior:

We enforce a ZERO ABUSE POLICY. Abusive language or behavior toward staff will result in immediate termination of services, with no refunds.

Hours of Operation:

We operate Monday through Friday, 9 AM to 6 PM EST and are closed on weekends and major US/PR holidays. Support inquiries made outside of these hours will be addressed during the next business day.

Final Agreement:

By proceeding with our services, you agree to abide by these terms and conditions. MTTuned.com reserves the right to terminate agreements at our discretion for non-compliance or disruptive behavior.
